Privacy Policy and Data Protection Information

SCOPE AND CHANGES

This is a general notice about the processing of employees' personal data within TERRATEST according to the General Data Protection Regulation (GDPR) and the applicable local laws. When relevant and/or legally required, you will receive a notice from our organization, which may modify and supplement some of the information.

This notice may be updated from time to time, in which case you will receive a promptly updated notice with information about relevant changes.


DATA PROCESSORS AND CONTACT DETAILS

TERRATEST is a matrix organization and all its entities are responsible for the joint processing of personal data. The essence of the agreement between the data controllers is that their own organisation has the primary responsibility to serve as a point of contact, but also when exercising its rights, it is entitled to exercise its rights in respect of and against each data controller. Lawfulness of processing and purposes of the personal data we process.

We only process personal data that are necessary for the performance of our functions. Depending on the purpose for which you have contacted us, the type of processing will be of one type or another.


Potential Clients

Lawfulness of Processing: Legitimate interest in the processing of contact data of a professional nature and of individual entrepreneurs;

Purpose: Management of potential customers through contact, sending information, communications and registration of requests for issuance and award of tenders.

Storage periods: the data of potential clients will be kept until the deletion is requested by the interested party.

Recipients: your data will not be transferred to third parties except for other companies of the TERRATEST Group whose relationship can be found here.


Customers

Lawfulness of Processing: Commercial contract between the parties or for the application of pre-contractual measures; Legitimate interest in the processing of contact data of a professional nature and of individual entrepreneurs.

Purpose: Client management, tax and administrative accounting. Commercial.

Period of conservation: while the commercial contract is maintained and subsequently while the legal obligations of conservation last.

Recipients: your data will not be transferred to third parties except for other companies of the TERRATEST Group whose relationship can be found here.


Suppliers

Lawfulness of Processing: Commercial contract between the parties; Legitimate interest in the processing of contact data of a professional nature and of individual entrepreneurs;

Purpose: Management of suppliers.

Periods of conservation: while the commercial contract is maintained and subsequently while the legal obligations of conservation last.

Recipients: your data will not be transferred to third parties except for other companies of the TERRATEST Group whose relationship can be found here.


Job applicants

Lawfulness of Processing: Legitimate Interest as stipulated in Opinion 2/2017 of the Working Group of 29; Express Consent of the interested party;

Purpose: Management of candidates for employment in recruitment processes.

Retention Period: Candidate data will be kept for the duration of the recruitment process in which they are participating and subsequently, if they have given their consent, until the data subject exercises his/her right to delete them.

RIGHTS AS AN INTERESTED PARTY

Next, we will explain the rights that you can exercise as an interested party in TERRATEST. In order to exercise any of these rights, you must contact us at lopd@terratest.com.

RIGHT TO WITHDRAW CONSENT

If you have given your consent to the processing of your personal data for one or more purposes, you have the right to withdraw your consent at any time (without affecting the legality of the processing before withdrawing it).

To withdraw your consent, simply contact us in the same way you provided your consent in the first place, delete your data where appropriate or contact the Human Resources Department.

RIGHT OF ACCESS AND RECTIFICATION

During the entire period, we process your data, you can access your data, as well as correct incorrect data corrected. You have the right to obtain a copy of your data, which will be provided to you in a manner that respects the rights and privacy of others. You also have the right to ask us to provide you with all relevant details about the processing of your personal data.

DATA PORTABILITY RIGHTS

Where you have provided us with your data under or as a result of a contract between you and our organisation, such data is subject to data portability rights.

This means that you have the right to receive such data in a portable format (structured, commonly used, machine-readable format) and to have it transferred to you or, where technically feasible, directly to another data controller.

Please note that the data will be provided to you in a way that respects the rights and privacy of other persons.

RIGHT OF OBJECTION

You may object to the processing of your personal data in relation to your situation. This is relevant provided that the processing is based on legitimate interests. If you wish to exercise your right to object, please contact the Human Resources Department.

INDIVIDUAL DECISION MAKING

In order to manage our staff and be effective as an employer, we are using some automated tools and ratings based on criteria relevant to the job, however, at no time do we make decisions based on automated treatments that may produce legal effects on you or that may significantly affect you in a similar way.

RIGHT OF WITHDRAWAL (RIGHT TO FORGET)

You can request that your personal data be deleted and not processed. However, if we still need and/or are legally obliged to keep such information, the achievement of this may be postponed. In such situations, you will be expressly informed, what the reason for such postponement is, and what the expected time of deletion is.

If you wish to have your data deleted, please contact your Human Resources Department.

RIGHT TO LIMITATION OF TREATMENT

Instead of deleting it, you can request to restrict your data. Further processing of restricted data can only be carried out with your consent or for reasons expressly stipulated in applicable legislation.

If the restriction is not possible, because we need and are legally authorized or required to process the data, you will be expressly informed of these reasons.

You will be informed before the restriction is lifted. If you wish to have your data restricted, please contact the Human Resources Department.

COMPLAINTS

If you are not satisfied, in particular with the way your data is handled, with the information you receive or for any other reason related to the protection of your personal data, please contact the Human Resources Department. You may also contact the organization's Data Protection Officer directly at lopd@terratest.com.

RIGHT TO COMPLAIN TO A SUPERVISORY AUTHORITY

If you consider that the processing of your personal data violates EU law, you have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of your habitual residence, place of work or place of the alleged violation.

Each authority must have a website available in its official language where all the necessary details are explained. If you have any problems establishing this information yourself, you can contact your local human resources department for assistance.


SECURITY

We implement reasonable technical and organisational measures to protect your personal data and to ensure that such data is processed in accordance with applicable laws and regulations. We also ensure that we have appropriate non-disclosure, data processing and other agreements and arrangements in place to ensure that your data is adequately protected.
